Delmarva Adjusters helps lenders, finance companies, and creditors recover collateral across Delaware, Maryland’s Eastern Shore, and Virginia’s Eastern Shore.
Every recovery assignment is different. The type of collateral matters. So does its location, condition, and the lender’s legal right to recover it.
Our goal is to review the details, identify what the assignment needs, and determine how to move forward.
Collateral Recovery for Lenders
When a borrower defaults on a secured loan, the lender may have the right to recover the property used as collateral.
Cars and trucks are common examples. Other assets can include trailers, construction equipment, commercial vehicles, and business property.
Some assets are harder to recover than others. A passenger car might be parked at a home or apartment complex. A piece of heavy equipment could be at a construction site miles from the borrower’s address.
These situations call for different plans. Larger assets may also need special equipment, transportation, or storage.
What Do We Need to Review an Assignment?
Good information helps get an assignment off to the right start. It also helps avoid delays and unnecessary expenses.
Here are some details lenders should provide:
- Asset information: Year, make, model, VIN, serial number, or other identifying details.
- Last known location: Where the collateral was last seen or reported.
- Loan documents: Information showing the lender’s interest in the property and right to recover it.
- Asset condition: Whether the property runs, needs repairs, or requires special handling.
- Location history: Prior addresses, recent sightings, or places the borrower may keep the asset.
- Special instructions: Any requirements for handling, transportation, or storage.
Don’t have every detail? You can still submit the information available for review. Missing details may affect whether the assignment can move forward.
Recovering Commercial Collateral
Commercial collateral can be more complicated than a standard vehicle repossession.
A work truck might contain tools or other property. A trailer could be loaded or parked behind a locked gate. Construction equipment may need a special truck to move it.
These details matter before recovery begins.
We need to know what the asset is, where it’s located, and whether it can be moved safely. We also need to understand any special instructions from the lender.
Not every assignment can be handled the same way. Specialty assets are reviewed individually to determine what resources are needed.
Legal Requirements for Collateral Recovery
Lenders must have the legal right to recover an asset before a repossession begins.
Under UCC Section 9-609, a secured creditor may take possession of collateral after default. However, a repossession without a court order cannot involve a breach of the peace.
Other laws and requirements may also apply. These depend on the state, the loan agreement, and the type of property.
Lenders should confirm their recovery rights and provide the necessary authorization before an assignment begins.
Collateral Recovery Across Delmarva
Delmarva covers a large area with different types of communities. It includes busy commercial centers, small towns, rural roads, and coastal communities.
A borrower may live in one town and keep the collateral somewhere else. Vehicles and equipment can also move between Delaware, Maryland, and Virginia.
Knowing where an asset was last seen can help narrow the search.
